What is the process to determine that an area qualifies as an “area in need of redevelopment”?
  1. The first step is for the Town Council to adopt a resolution directing the Planning Board to conduct a preliminary investigation of the area to determine if it qualifies under the Local Redevelopment and Housing Law.
  2. The Planning Board will then generally engage a planner to conduct the preliminary investigation and produce a report setting forth the planner’s findings and conclusions.
  3. A public hearing will be held by the Planning Board to review such findings and reports, during which the public is given an opportunity to ask questions of the planner, present its own evidence and witnesses, and make comments regarding the investigation.
  4. The Planning Board will then adopt a resolution either agreeing in whole or in part with the conclusions of the planner and recommending that the area, or any part thereof, be delineated as an area in need of redevelopment, or rejecting such conclusions and not recommending the delineation.
  5. The Town Council may then act to accept, reject or modify such recommendations and adopt a resolution delineating the area as an area in need of redevelopment.
